Airwaves are public property. In a case, this decision was given by the Supreme Court in 1995. The lawsuit was between India's Ministry of Information and Broadcasting and the Cricket Association of Bengal.
The controversy was over whether the Cricket Association had the right to grant exclusive broadcast rights to a private agency instead of Doordarshan. The dispute arose over the broadcast rights of a six-nation cricket tournament held in 1993.
In this case, the Supreme Court held that the airwaves or frequencies were a public property. Their use had to be controlled and regulated by a public authority in the interests of the public and to prevent the invasion of their rights.
The Supreme Court said that the Central Government shall take immediate steps to establish an independent autonomous public authority representative of all sections and interests in the society to control and regulate the use of the airwaves.
